Loler 98, Puwer 98 and Thorough Examinations

We at Ness Plant are committed to delivering a first class service and are constantly looking at ways in which we can improve our service. One way in which we believe we can better our service, is by giving you the choice to have your working equipment checked to meet PUWER 98 standards and to have your lifting equipment checked to meet LOLER 98 standards.

What is LOLER 98?

LOLER is aimed at ensuring that all lifting operations are properly planned, that lifting equipment is used in a safe manner and that, where necessary, lifting equipment is thoroughly examined at suitable intervals by a competent person.

What is PUWER 98?

Provision and Use of Work Equipment Regulations 1998 (PUWER 98) are made under Health and Safety at Work Act 1974 (HSW Act) and came into force on the 5th December 1998. PUWER 98 brings into effect the non-lifting aspects of the Amending Directive to Use of Work Equipment Directive (AUWED). The primary objective of PUWER 98 is to ensure that work equipment should not result in health and safety risk, regardless of its age, condition or origin.

On completion of each thorough examination a certificate will be issued as a record that the machine has met the requirements under LOLER / PUWER 98.

What is Thorough Examination?

A Thorough Examination is an essential, mandatory check to ensure that your trucks are in safe working order. In simple terms, you can think of a Thorough Examination as being the fork lift truck equivalent of an MOT. It is not the same as any regular checks your trucks may have as part of scheduled service plan.

It is required by law, and covers two different sets of Health and Safety regulation(s): LOLER 98 and PUWER 98. The LOLER and PUWER legislation covers different areas of a truck’s operation, so a truck that passes LOLER 98 could still leave you liable under PUWER 98, and vice versa. This is why a Thorough Examination is paramount. It means you’re completely covered.

What the HSE say...

"The HSE recognises that thorough examinations carried out by a BAGMA approved competent person are an acceptable means by which users of lifting equipment can meet their legal obligations under regulation 9 of LOLER 98"
